History of the Malta Register of Ships

The modern day Malta Register of Ships was established in 1973 as an open international register of shipping.

The regulator of the Malta Flag, the Malta Maritime Authority, was set up In 1991 the Malta Maritime Authority was established as the regulator and administrator of the Malta Register of Ships.

In 2010, the Malta Maritime Authority was incorporated into Transport Malta (TM) which is a governmental body responsible for maritime, land and air transport in Malta.

Port of Registry

The sole port of registry under the Malta flag is Valletta. This means that the word VALLETTA appears on the stern of all Malta registered vessels.

The Flag (‘Ensign’)

The Malta merchant ensign was adopted on the 12th November 1965. The design of the ensign was based on the flag flown by the Knights of the Order of St. John in Malta up to 1798 to which a white border has been added.

The Certificate of Malta Registry

Upon completion of registration formalities a Malta registered yacht is issued with a Certificate of Malta Registry valid for one year from the date of issue.

Eligibility – Yachts

Malta will accept private pleasure yachts of any size and commercial yachts over 15 metres in length that are based and operated anywhere in the world.

Eligibility – Owners

Malta is an international register meaning that the register is not just restricted to Malta registered companies or Maltese citizens; in fact the following citizens and companies may register a yacht in Malta in their own name:

  • Any European citizen 
  • A company or other body incorporated in any jurisdiction

A European citizen or a non-Malta company registering their yacht in Malta is known as an international owner.

An international owner must appoint a local resident agent in Malta to act as a channel of communication between the international owner and the registry in respect of all matters relating to the upkeep of their yacht’s registration and to act as the owner’s judicial representative in Malta.

Vessel registration under the Malta flag and the operation of Maltese ships is regulated by the Merchant Shipping Act of 1973, a law based in the main on United Kingdom legislation but subsequently revised and amended in 1986, 1988, 1990, 2000 and 2010. The main legislation is supplemented by a comprehensive set of rules and regulations.

The Malta Flag formally came into existence as an ‘open’ register in 1973 with the promulgation of the Merchant Shipping Act, Chapter 234 of the Laws of Malta. It has experienced significant and constant growth since inception and has now established itself amongst the largest registries in the world in terms of tonnage. The phasing out of single hull tankers has significantly lowered the average age of the fleet and Malta’s accession to the European Union in 2004 has gone a long way in adding its attraction to operators and charterers alike. The administration of the Malta Registry of Shipping and Seamen is now, more than ever, giving increasing and fundamental importance to safety of life at sea and the prevention of pollution as well as compliance with international maritime conventions.

The Malta Registry of Shipping and Seamen (the “Registry”) is administered by the Merchant Shipping Directorate of the Authority for Transport in Malta.

The Merchant Shipping Act provides that the homeport of every Maltese vessel shall be VALLETTA. Furthermore, the flag set out hereunder is the proper maritime flag for all Maltese vessels. It consists of a red field bordered in white, with a Maltese Cross at its centre.

It is important that the owners and masters of Malta Flag vessels ensure that the homeport VALLETTA is marked on and the national colours hoisted on board Maltese vessels.

Malta Ship registration – ultimate guide 2023

Procedure of registration under maltese flag for:.

⚓    Superyacht in commercial use. ⚓    Yacht registered in the name of incorporated company. ⚓    Private boat registered in the personal name of the individual.

Registration procedure for superyacht in commercial use.

Ships in commercial use, which do not carry cargo and do not carry more than 12 passengers can be registered as Commercial Yachts .

All ships registered in Malta as a Commercial Yachts are issued with a Certificate of Compliance to trade. This certificate confirms that the yacht complies with the standards established in the Malta Commercial Yacht Code.

Compliance is verified through a survey carried out by an Appointed Government Surveyor or by a Classification Society recognised by Transport Malta, which are:

  • American Bureau of Shipping (ABS) b. Bureau Veritas (BV) c. China Classification Society (CCS) d. ClassNK (NK) e. Det Norske Veritas (DNV) f. Germanischer Lloyd (GL) g. Korean Register of Shipping (KR) h. Lloyd’s Register (LR) i. Polish Register of Shipping (PRS) j. Registro Italiano Navale (RINA)
  • Indian Register of Shipping (IRS)

In accordance with the local maritime legislation in case of non-Maltese owners, the local resident registered agent has to be appointed at all time, that is the service our firm provide to the foreign clients.

To act as an appointed agent, we would need to be given a power of attorney (notarised with apostille, and translated in English, if issued abroad) to carry out the registration on behalf of the client. We could draft such document giving us mandate to do so.

Documentation applicable for the ship registration:

Provisional Registration:

  • Power of attorney authorising us to act on your behalf in all matters relating to the registration of the yacht;
  • Application for Registration by owner or authorised representative (must include hull identification number);
  • Proof of Qualification to own a Maltese ship, in case of body corporate the Memorandum and Articles of Association (see further – M&AA);
  • Declaration of ownership to be sign in front of Registrar by the owner or authorized representative;
  • Application for Ship Radio station Licence – if you already have a radio on board, a form would need to be completed where the technical details of the radio on board would need to be provided. So it is not a license per se but a registration;
  • A copy of the current International Tonnage certificate (for the ships over 24 metres);
  • Certificate of Compliance to Trade for yachts of 15 metres in overall length, not carry cargo and more that 12 passengers;
  • Application for Minimum Safe Manning Certificate (Ships of more than 24 metres);
  • Payment of registration fees. This varies depending on the gross tonnage of the vessel.

Upon presentation of the requested documentation, the Registrar will release:

  • The provisional certificate (valid for 6 months from the date of provisional registration);
  • Provisional Radio Licence;
  • Carving and Marking Note (this is first issued by TM and then completed and stamped by the Surveyor).

The following list of documents must be submitted within 6 months of the provisional registration in order for the permanent registration to be processed:

  • Deletion certificate from previous registry (if applicable);
  • Carving and Marking Note (This is first issued by TM and then completed and stamped by the Surveyor);
  • Original Bill of Sale or Builder certificate if applicable;
  • Copy of the last updated Continuous Synopsis Record issued by the Administration where the ship was last documented, in cases of commercial yachts over 500 gross tons;
  • Certificate of Survey and a copy of the international Tonnage Certificate issued by an approved ship’s surveyor;
  • Copy CE Marking Certificate (manufacture certificate) for the yacht, which is over 24 metres;
  • Return of Provisional Certificate.

Once the yacht is registered, the Surveyor will make contact with Transport Malta and they will communication whether all documents in terms of the Commercial Yacht Code are in order for the registration Certificate to be issued.

A certificate of Malta registry is subject to renewal on the anniversary of the Maltese registration.

Commercial yachts, which fly Maltese flag, and registered under commercial license, are exempt to pay income tax on their profits.

Registration fees paid to Malta Transport:

Tonnage tax – is being paid one time, when register a boat, and then annually to get certificate extended. It varies depending on the length and gross tonnage of the ship (follow Tonnage tax).

Procedure of registration for private boat registered in the name of incorporated company.

All EU/Non-EU nationals may establish a company in Malta and register the boat on behalf of this same company to use it for the sole purpose of the ship owner.

If the ship owner setups a Maltese limited company , the latter can own the boat without problems directly.

If the corporate entity is already established in the EU to acquire and operate sea faring ships and that the legal documents of such company (including a certificate of good standing) the ship may be registered under Maltese flag in the name of this establishment.

Documentation applicable for the boat registration.

  • Power of attorney authorising us to act on your behalf in all matters relating to the registration of the ship;
  • Application for Ship Radio station License – if you already have a radio on board, a form would need to be completed where the technical details of the radio on board would need to be provided. So it is not a license per se but a registration;
  • International tonnage certificate (for the yachts over 24 metres);
  • Payment of registration fees. This varies depending on the gross tonnage of the ship.

You would need to advise who will be carrying out the ship’s survey, with full details of person and also location of where the survey will be effected. Maltese registry only accepts surveys registered and licensed with any of the following authorities (other than obviously with Transport Malta itself):

  • American Bureau of Shipping (ABS)
  • Bureau Veritas (BV)
  • China Classification Society (CCS)
  • ClassNK (NK)
  • Det Norske Veritas (DNV)
  • Germanischer Lloyd (GL)
  • Korean Register of Shipping (KR)
  • Lloyd’s Register (LR)
  • Polish Register of Shipping (PRS)
  • Registro Italiano Navale (RINA)

Once you advise on who the surveyor will be, upon application for the Provisional Certificate, we will inform Transport Malta who will write to the said surveyor and give the necessary go ahead.

  • Carving and Marking Note.

Permanent Registration:

The following list of documents must be submitted within 6 months of the provisional registration:

  • Certificate of Survey;
  • For the yacht, which is over 24 metres, Copy CE Marking Certificate (manufacture certificate);

Upon submission of the above documentation, the boat will be permanently registered under the Malta flag.

  • If the pleasure yacht is registered in EU and used in EU territorial water, it needs to be VAT paid.
  • If the pleasure yacht is registered in the EU and its use is in non-EU territorial water, it does not need to be VAT paid.
  • Once, the company with the non-resident shareholding ends the financial year with the profit, Maltese taxation and legal system give those clients the opportunity to apply for the Tax refund, and in essence enable an effective income tax rate of 5% in Malta.
  • Possibility of tax consolidation for Maltese groups, to eliminate the need to claim tax refunds as aforesaid and wherein to pay directly the effective rate of 5% (when tonnage taxes do not apply)

Private boat registered in the personal name of the individual.

It is possible to register a boat in the personal name of the EU citizen to use it for the sole purpose of the owner.

  • Power of attorney authorising us to act on your behalf in all matters relating to the registration of the boat;
  • Proof of Qualification to own a Maltese ship (builder certificate and bill of sale);
  • A copy of the current International Tonnage certificate (for the boat over 24 metres);
  • Payment of registration fees. This varies depending on the length and gross tonnage of the ship.
  • Carving and Marking Note
  • Deletion certificate from previous registry;
  • If the pleasure yacht is registered in EU and its use is in EU territorial water, it needs to be VAT paid.

Private Yacht Registration

Provisional registrations are valid for six months. In order to register your yacht permanently under the Maltese flag, you must provide the following documents within six months from provisional registration:

  • yacht survey certificate from an authorized surveyor in the port where the yacht lies attesting the yacht's seaworthiness; should your surveyor have difficulty in obtaining the official Malta Maritime Authority form
  • a survey certificate form can be provided
  • only if your yacht is more than 24 meters in length, we will need an International Tonnage Certificate
  • a bill of sale showing that your Maltese company has bought the yacht; or a builder's certificate in the name of the Maltese company if the yacht is new or has never been registered anywhere previously
  • a radio installation form and a radio license application which we will provide to you after provisional
  • registration which must be completed by an authorized surveyor in the port where the yacht is berthed.
  • a Carving and Marking note from an authorized surveyor in the port where the yacht is berthed; this is a form which we will provide after provisional registration

if the yacht has been registered previously outside of Malta, a certificate showing cancellation of registry from that last country of registry (deletion certificate)

Procedure for Yacht Registration in Malta

When vessels are owned by international owners, they can be registered in two ways:

  • By appointing a Maltese registered agent , in case if International Owner is an EU citizen or foreign company; or
  • By incorporating a Maltese company and registering the vessel in its name, in case if International Owner is a non-EU citizen.

Firstly, a vessel is registered in Malta provisionally . Upon issuance of the provisional certificate of registration, which is valid for 6 months period, the yacht owner has to provide the remaining required for the registration documentation. Once all the necessary documents are presented to the authority, the owner of the vessel is issued with the permanent certificate of Malta registry.

A permanent certificate of Malta Registry is subject to annual renewal on the anniversary of 1st registration.

Appointment of resident agent in Malta

The duties of a resident agent include but not limited to:

  • Applying on behalf of the international yacht owner, for the registration of a ship.
  • Liaising between the international yacht owner and the Maltese government departments and authorities.
  • Signing and filing all declarations and forms as required with the Maltese government departments and authorities on behalf of the international yacht owner.
  • Paying all the relative fees and taxes payable in terms of Maltese law.
  • Arranging for authentication of documents issued by the international owner.

Incorporation of a Shipping Company in Malta

It is also possible to incorporate a company under the Merchant Shipping (Shipping Organisations – Private Companies) Regulations . A Company shall qualify as a Shipping Company if its main purpose concerns the ownership, operation (under charter or otherwise), administration, and management of a ship registered under the Maltese flag or of a ship registered under the flag of any other state.

A Shipping Company incorporated in Malta also benefits from Malta’s favorable ‘Tonnage Tax’ regime whereby the company shall pay a ‘tonnage tax’ instead of income tax on its profits.

Bareboat Charter Registration

A bareboat charter refers to the lease of a vessel for a stipulated period of time, by virtue of which the charterer shall acquire full control and complete possession of the ship, including the right to appoint her master and crew for the duration of the charter.

During the stipulated period of the lease, the charterer may register the vessel in the bareboat charter registry under the name of the charterer and under the Malta Flag.

Bareboat charters registered in Malta will enjoy the same rights and privileges and have the same obligations, as any other vessel registered in Malta.

In order for the bareboat charter to be registered, the charterer must be a person qualified to own a vessel in Malta.

Malta Yacht Registration Process

Malta offers  numerous  potential benefits and appealing incentives to yacht owners who register their vessels under the Malta flag. Any type of marine vessel, be it large cruise lines, super tankers or private yachts may be registered in Malta. Yachts, depending on their intended use, can be registered under the Maltese flag, as either private pleasure yachts or as a commercial yacht.

Whether your yacht is private or commercial, the process for registering a yacht in Malta is very straightforward and simple, and there are various advantages which the yacht owners could avail of.

STEP 1: Provisional Registration

Maltese Flag Yachts are first registered provisionally for six (6) months for the finalisation of the documents. Once all the required documentations are provided and the applications are submitted to the Authority for Transport in Malta, a non-operational Provisional Certificate Malta Registry is issued if fees are paid. Once evaluated, the Authority for Transport in Malta submits the necessary documents to the classified society for the issuance of the relative safety certificates, Certificate of Survey and International Tonnage Certificate.

STEP 2: Permanent Registration

After the provisional period, the Authority for Transport in Malta may require additional requirements depending on the type of vessels for the issuance of the permanent Certificate of Malta Registry. The Certificate is annually renewable from the date of registration.

Yacht Registration Malta: Types of Vessels

Private yacht.

The Merchant Shipping Directorate considers a private registered yacht to be any pleasure yacht, of 6 meters in length or more, which does not carry passengers for reward and is not engaged in trade but is used for the sole purpose of the owner.

Commercial Yacht

Yachts operated for commercial use which are 15 meters in length or more, do not carry cargo and carry no more than 12 passengers, can be registered as commercial yachts subject to compliance with the requirements of the Commercial Yacht Code drawn up by the Merchant Shipping Directorate within the Authority for Transport in Malta. The Code set the required standards of safety and pollution prevention.

The Merchant Shipping Act, Cap.234, and as subsequently revised, regulates the Vessel registration under the Malta Flag. Later amendments include important measures for control and added safeguards for financiers.

Yacht Registration

All types of vessels, trading or under construction, as well as Yachts, Super Yachts and Cruise Liners may be registered under the Valletta Flag provided that they are wholly owned by citizens of Malta; EU, EEA, Switzerland or Maltese shipping organizations.

“International Owners” may also register vessels under the Malta Flag provided that they appoint a “Resident Agent” in Malta.

Malta shipping company formation is a straightforward process with no restrictions on the nationality of shareholders and directors.

Maltese Law also provides for bareboat charter registration.

More Information

Inspections are not necessary for vessels under 15 years. Vessels aged between 15 and 20 years may undergo an inspection within one month of provisional registration. Ships of 20 years and over but under 25 years, are required to pass an inspection by a state inspector prior to being provisionally registered.

Malta is a party to most of the major IMO and ILO International Maritime Conventions including IMO Convention 48 and amendments 91 and 93, SOLAS Convention 74 and Protocol 78 and 88, Load Lines Convention 66 and Protocol 88, Tonnage Convention 69, COLREG Convention 72, STCW Convention 78 and 2010 Manila Amendments, Maritime Labour Convention 2006, SAR Convention 79, INMARSAT OA 76 and amendments 98, MARPOL 73/78 (Annexes 1 to 5) and Protocol 97 (Annex 6), London Convention 72, CLC Protocol 92, FUND Protocol 92 and Antifouling 01. Malta registered ships are obliged to adhere to the provisions of these international conventions.

Registering your Yacht under the Maltese Flag

When buying a yacht, one of the most vital factors is deciding on where you wish to register her. In this regard, the Maltese ship registry is considered to be one of the largest registries in Europe and is currently the sixth-largest registry in the world. This success has not materialised by chance, rather, it has been accomplished by means of constant efforts made towards the development, growth, and regulation of the yachting industry in Malta over the past decade.

The Maltese Flag is today considered a flag of excellence and one of the most prestigious flags a yacht may fly. This incredibly positive reputation boils down to the relevant authorities’ relentless efforts to foster the growth of this vital industry on the Maltese islands. The local industry’s success may be attributable to various factors which together have undoubtedly paved the way for the continued increase of yachts registering under the Malta flag. In this regard, a number of advantages of flying the Maltese flag are listed below:

  • Yachts may be registered on behalf of a company or another entity irrespective of nationality;
  • Low company formation , ship registration and tonnage tax costs;
  • Attractive tax incentives to yacht and superyacht owners;
  • No restrictions on the sale or mortgaging of Maltese registered yachts and superyachts;
  • Twenty-four-hour, seven days a week service from the Authority for Transport in Malta in response to urgent matters;
  • A good international reputation as a flag of choice and confidence;
  • Availability of a whole range of maritime services including very reputable and experienced legal and corporate services supporting registration, management, and administration;
  • A dynamic administration with one of the largest ship registers in the world and very active in European Union fora and international organisations;
  • A clear strategic vision supporting business and the marine industry;
  • A strategic geographical position .

Notably, there are two main types of yacht registrations under Maltese Law; one may either register their yacht as a pleasure yacht wherein the yacht shall be used for private use or for charters within Maltese territorial waters (once a CVC is obtained), or alternatively one may register their yacht as a commercial yacht wherein the yacht shall be used for commercial purposes including the option of sailing and chartering outside Malta's territorial waters.

Registration under the Malta flag shall firstly be a provisional one with further documentation to be provided within six (6) months from registration, for the purposes of permanently registering the yacht. Testament to Transport Malta’s efforts to maintain the Maltese jurisdiction’s high standards and efficiency in relation to yachting and shipping services offered, the process for registering a yacht under the Maltese flag is not too complex and CSB would assist from start to finish to ensure a smooth process. The estimated time frame for completion of the registration process depends highly on the time it takes the yacht owner/manager/resident agent to compile all the necessary documentation needed to be submitted to Transport Malta. Once all documentation is in order and duly submitted, the process may be concluded within a few days.

When a foreign individual/entity is looking to register a yacht under the Malta flag, whether new build or due to change in previous flag, the owner has two options at his/her disposal. The yacht may either be registered under the individual or entity’s name in which case a resident agent would need to be appointed in accordance with Maltese law, or alternatively, the owner may opt to incorporate a Maltese Shipping Company and transfer the yacht to the Maltese Shipping Company and have the yacht registered under the said shipping company. The latter option would give the individual or entity the opportunity to separate the asset. This latter option is highly advisable, especially if the intended use of the yacht is for commercial purposes.

In addition to the above, with regard to the incorporation/registration of a Maltese Shipping Company, subject to certain qualifications, one may be able to benefit from the low effective corporate income tax rate of 5%. Apart from certain exceptions, in order to benefit from such an effective tax rate of 5%, the Maltese Shipping Company would initially be required to pay tax at 35% on profits generated. The remaining 65% of profits would need to be distributed as a dividend to the shareholder, which shareholder would then be eligible to claim a 6/7ts tax refund on Malta tax paid, resulting in a net effective tax rate of 5% in Malta. Registering a company under the Merchant Shipping Act in Malta is quite straight forward. Corporate regulations have made it possible for companies in Malta to be incorporated with a single shareholder (unless the company would have a corporate director on its board), hence you could have a Maltese shipping company with one corporate/individual shareholder and an individual sole director. The minimum share capital requirement is EUR1,200.00 (or an equivalent of another currency) of which 20% as a minimum must be paid-up capital. Both the director and the shareholder may be non-resident and Maltese shipping companies that we would incorporate will typically have our address as their registered office address and we will also act as the company’s local special attorneys. Given corporate documentation and authorities may be attended to in Malta, being appointed as special attorneys would facilitate the necessary communication with the relevant Maltese authorities.

In an effort to reduce the transmission of COVID19, Transport Malta has implemented measures to provide online services in relation to yacht and boat registration under the Valletta Registry.

These services include:

• Renewal of the Certificate of Registry;

• Provisional and permanent Registration;

• Transfer of Ownership;

• Any other ancillary services.

All payments are to be made by Debit or Credit Card.

Transport Malta is taking these measures to minimise contact between individuals as all clients are served from their own home.
