Second hand boats: buying a yacht in Europe

Buying a yacht in the EU is more complicated than it once was, following Brexit, but there’s now a growing bank of knowledge on how to smooth the process. We get expert advice on some of the key questions.

Double VAT, the Schengen zone, the 180-day rule; the list of considerations when considering buying a yacht in Europe is long and, in some cases, very complex. Crucial to understanding is having a grasp of some of the legal and tax principles that govern making a purchase. The following is not intended to be comprehensive and we advise getting specialist guidance from a tax adviser or similar.

Linda Jacques, partner at LA Law, a firm specialising in marine law and yacht transactions, says the first thing you should consider is where you are going to use the yacht you’re thinking of buying. “Since leaving the EU, it is true that things have got more complicated, but the principal legal questions surrounding ownership and tax haven’t changed that much. A lot revolves around the location of the yacht,” explains Jacques. “First, before you start looking to buy, consider where you are going to flag moor the yacht.”

Jonathan Hadley-Piggin, a partner at Keystone Law, explains that location is also crucial to the transaction. “Making a purchase of a yacht within an EU country isn’t the problem people often see it to be, but you need to be clear if you are paying VAT or if VAT is already paid and provable. Under some circumstances VAT can be avoided by concluding the sale outside EU territorial waters.”

The VAT factor

VAT is often the first concern that comes to mind for potential buyers because it can make a 20% difference in price.

As Jacques explains, one of the challenges of Brexit is that you can end up having to pay tax again when you return your yacht to the UK.

“ Buy a yacht in Europe and keep it there and you don’t have a problem, as long as EU VAT has already been paid and can be clearly proven. Yachts within EU waters must be EU VAT paid and have proof unless the owner is able to qualify for customs relief. Customs relief includes Temporary Admission or a VAT exemption for a yacht that is operated commercially. Commercially operated yachts have their own specific requirements and need to prove the nature of their operation is truly commercial.”

However, if you are purchasing the yacht in Europe and bringing it back to the UK, proof of where the yacht has been in Europe and on what date the transaction concluded is crucial. “If you are the new owner, even if VAT has been paid before, you will be liable for import tax coming into the UK,” Jacques advises. “VAT must be paid again on all EU VAT-paid yachts being brought into the UK. In the UK the UK Border Force form C1331, where you declare the VAT status of the boat, where it has been and at what time, is an important document.”

The non-VAT paid yacht is a more complicated prospect, as Jonathan Hadley-Piggin explains. “We get calls from people thinking that a non-VAT paid yacht can’t be bought, or it’s simply too risky. It can, you just need to understand how to go about it and, if necessary, the new owner might need to pay the VAT to use it in the way they want to.

“It’s also worth considering how, as a new owner, you are proving VAT has been paid. For example, if the boat was initially purchased by a company and VAT was paid, but as a company they claimed the VAT back through their corporate accounts, it might be considered by the authorities that VAT has not been paid. It is this kind of issue that a good marine lawyer and tax adviser can help you understand fully. Quite often the current owner really does think VAT is paid and that their paperwork is correct, when in fact it is not, so it’s important to ask questions around what proof is available early on if you’re serious about buying.”

Michael Ashdown of Harwood Hutton VAT Consultancy regularly advises yacht owners. “You should be looking initially for the original sales invoice, subsequent sales invoices and/or an importation invoice; always asking the question ‘Would this satisfy an inquisitive customs officer further down the line?’

“We are now seeing an increasing number of clients who are choosing to pay EU VAT, knowing that it will ensure their yacht has true free movement within the EU without complexity.”

Time aboard

While buying a yacht in the EU is possible for a UK citizen, being able to use it is another matter. An extended season of Mediterranean cruising for most is no longer an option, due to the Schengen restrictions meaning no British citizen can spend more than 90 days in the EU in one 180-day period. This means that some buyers looking to cruise for longer are investigating other options to allow them to stay in Europe. Remember that the rules for a yacht are separate to the rules for people.

Dave Birch bought his yacht to take a sabbatical with his wife and daughter, but found himself confronted with the prospect of a shortened season before he’d even completed the sale. “There are options, heavily dependent on your individual circumstances, but to keep cruising we have seriously investigated different ways to spend more time in Europe. Maltese residency can be purchased by investing in private property or business, granting an EU passport and access rights, but it is a serious amount of money that some would think extreme just to be able to keep sailing.

“Other options are so called ‘digital nomad’ visas, allowing those working while living afloat the potential to stay for longer and continue cruising. What is clear is that, at present, there’s no cheap or easy option.”

Many cruisers build time out of the EU Schengen zone into their cruising plans to take maximum advantage of the time allowance. For example, Croatia is not currently part of the zone.

Areas of confusion

Alex Grabau has been brokering yachts in Europe throughout Brexit. “There’s still a huge amount of confusion, particularly for UK buyers keen to buy second hand boats located in Europe. A lot remains unclear, even where there are written rules in place.

“Returned Goods Relief (RGR) is the most common area of misunderstanding,” he explains. “RGR is only available to boats where the importer is the same as the original exporter. If a VAT-paid boat is sold outside of the UK, the new owner may be liable to pay VAT if the boat is brought back into the UK.

“This currently also applies to UK owners of VAT-paid boats bought and then kept in the EU while the UK was still part of the EU28, which now would like to come to the UK.

“Even if the boat was originally UK VAT paid, or kept in the UK in a previous ownership, the owner and their boat may not be eligible for RGR and could find themselves with a sizeable VAT liability upon arrival in the UK.”

Another area of confusion relates to Temporary Admission (TA) which is applicable in both the EU (for non-EU boats) and the UK (for non-UK boats). “Many UK buyers believe they can buy a yacht in Europe then bring it back to the UK temporarily before heading off on their planned adventures. This is not the case, as eligibility for UK TA requires the boat is registered outside of the UK and used by a non-UK resident. There is no grace period offered by HMRC, so even spending a day in the UK may result in a VAT liability.”

Grabau also regularly comes up against misunderstandings about the difference between Europe and the European VAT area. “It can be unclear when a boat is sold in places such as Martinique, Guadeloupe, Saint Martin and the Canary Islands. These are all territories within the EU, but fall outside of the EU’s VAT area. Buying an EU VAT paid boat in these territories may see the VAT paid status lost.

“Care also needs to be taken when boats are in the Channel Islands as they fall outside of the UK’s VAT area.”

The right mark

While VAT issues can ultimately be resolved through writing a cheque, Grabau sees the UK’s introduction of its own build standard (the equivalent to the EU’s Recreational Craft Directive) potentially creating more hurdles.

“Bringing a yacht back to the UK market may soon be more of an issue because a compliance survey may be needed and some yachts may not be considered importable, or too difficult to import to the UK.”

Alasdair Reay is a naval architect and CEO of HPI Verification Services, a business that helps yachts comply with build standard regulations and undertakes compliance surveys. He adds: “Since leaving the EU, the UK has introduced its own CA mark. Most recently-built CE-marked yachts will not need a survey to comply with the CA standard.

“However, the UK government’s position on second-hand yachts is still not clear. If you do need a survey, the cost for a 50ft yacht would likely be £4,000-£10,000. If the build standards and technical data are available to us, it’s a cheaper paper-based exercise, but where it is not a survey can be necessary to formally document the yacht’s construction.”

Buying a yacht in Europe – case study

Tim (who wishes to remain anonymous) found his ideal cruising yacht online, located in Spain. The prospect of buying a yacht in Spain following Brexit immediately posed several questions, particularly considering his cruising plans. “The yacht was UK VAT paid but had been present in the EU on 31 December 2020 and so also had EU VAT status. As VAT status does not survive a change of ownership, we had to make a choice between the ability to bring the boat back to the UK and our initial plan, which was to cruise Europe.

“We decided to maintain UK VAT status. This necessitated a survey and acceptance of the boat in the EU, followed by a Biscay crossing to conclude the sale in the UK, with all the logistical hurdles that that entailed.”

Last week, the last BAVARIA VISION 42 was completed in Giebelstadt. On Friday morning, part of the BAVARIA YACHTS team gathered to give her a fitting farewell. The sailing yacht celebrated its premiere at the boot Düsseldorf in 2012 and the almost 13 metre long yacht was built in the shipyard for just over 12 years.

European yacht charters are growing in popularity for the more experienced charterer - even when leaving aside the most popular Mediterranean counties. Anyone on a yacht charter holiday in the British Isles or Europe will experience great cultural and scenic variety. There are yacht charter operators in England, Scotland, Ireland, Brittany, Holland, Sweden and Norway, to name a few. There are also yacht charter locations for every level of skill, experience and budget from the shallow east coast of England to the rugged highlands of Scotland and the soaring fjords of Norway. Scotland can sometimes be tranquil and sometimes rugged; Britain can be sometimes busy and sometimes deserted; Brittany can be sometimes sunny and sometimes rainy. No matter what you desire you will no-doubt encounter a concentration of history and culture.

Europe is one of the world's seven continents. Europe stretches from the westernmost peninsula of Eurasia, to the Ural and Caucasus Mountains in the east where is it 'divided' from Asia. Europe is bordered by the Arctic Ocean and other bodies of water to the north, the Atlantic Ocean to the west, the Mediterranean Sea to the south, and the Caspian Sea, Black Sea and connected waterways to the southeast.

‘Europe’ therefore does include countries that borders with the Western Mediterranean Sea such as the popular yacht destinations of Spain, France and Italy, however these well developed yachting destinations found in Southern Europe are discussed in more detail under the Western Mediterranean yacht charter section .

Northern Europe has all the main types of yacht charters available in the United Kingdom (England, Ireland, Scotland, Wales) Scandinavia (Denmark, Norway and Sweden) Germany and Russia, including motor, sailing, skippered, crewed yachts, catamaran, power boat, sailboat, luxury yachts and motor yachts. There are also more and more superyachts that visit the area, available for charter including explorer yachts or expedition yachts. Weather patterns make Northern Europe’s summer charter season shorter than that in the Mediterranean, which is why fewer luxury yachts tend to be permanently based in Northern European waters. Summer, from May to about September, is the main season and the best time to charter a yacht in Europe.

Yacht chartering in Scandinavia offers charters the possibility to explore the regions mighty Norwegian fjords, un-crowded serenity and peaceful historic ports. Norway boasts beautiful glaciers, some of which actually tumble down from the mountains to meet the sea. Finland’s famous energetic capital city Helsinki is also on the water and displays an artistically rich artistic cultural center. The magical cruising areas of Sweden reveal a tapestry of glistening lakes neat and vibrant cities, whilst Denmark’s Jutland peninsula is another magical location.Time spent on a luxury yacht charters in Scandinavia are relaxed and slowly paced, as the summer months provide more than 20 hours of sunlight each day so there is simply no reason to rush through the spectacular environment.

Norway, Europe

United Kingdom

The United Kingdom which includes England, Ireland Scotland and Wales is a famous and ancient yachting location. England, a place of sailing tradition has of the world's most important and longest running sailing regattas including the Fastnet and the Around the Island Races. The America’s Cup began here, but there are also new sailing races in and around the Solent, such as the 2012 J Class classic sailing events.

An Ireland yacht charter offers numerous marinas, ports and local pubs where you can sample some Guinness share a laugh and hear a song. Admire the Royal Cork Yacht Club, the oldest yacht club in the world, Bantry Bay and Oysterhaven harbor. An area of outstanding natural beauty, Scotland’s west coast embodies intrigue and mystic with mist-shrouded lochs as well as atmospheric port towns. While a yacht charter up the North Wales coastline provides dramatic scenery, wildlife and hidden coves. Anglesey and the North Wales coast is becoming an increasingly popular location for yachting and chartering and offers a variety of unspoiled beaches, sheltered anchorages and marinas within comfortable cruising distance.

Most tourists know of London and Shakespeare's birthplace, Stratford-Upon-Avon, but few have cruised along the winding coastline to witness the patchwork hills of East Anglia, or the rugged, rocky shores of Scotland that are home to puffins, seals and whales. Charming villages, grandiose castles and impressive country homes are all within easy reach of the beaches and coves, which are excellent in themselves for water sports and Scuba diving on an adventure holiday.

The Baltic Sea

Germany and the Baltic Sea has a yachting history dating back to ancient seafarers. This is contrasted with an area which now, in modern times, is the birth place of some of the world’s most important superyachts by shipyards like Lurssen, Abeking & Rasmussen and Blohm & Voss. Island groups in the Baltic Sea provide a variety of seaside towns and villages to visit, as well as picturesque landscapes far off the beaten track. Russia has also seen some yacht charters over the last few years. St. Petersburg is the cultural capital of Russia and few cities showcase as many art galleries, concert halls, museums and theaters that can compare.

Head off the beaten track and discover some of Germany's hidden gems along the north coast in the Baltic Sea. National parks are nestled between scenic villages, where modern buildings blend with centuries of history to create a tranquil setting for guests to take in at their leisure.

The Baltic Sea is home to some of the most prestigious superyacht shipyards in the world and as you cruise through you might be one of the first to see a brand new luxury yacht undergoing sea trials in preparation for delivery to their new owner.

To the east, St Petersburg is one of Russia's most iconic locations and as a culture capital, charter groups have plenty of indoor and outdoor exhibitions to discover to the backdrop of broad canals and brightly coloured spires. This world-class destination offers the awe-inspiring Museum Complex St. Isaac's Cathedral, the Peterhof Grand Palace and the State Hermitage Museum and Winter Palace, which is filled with the works from the Masters.

Hi Amanda, The boat was great. The staff were too. Marin in particular. He was super knowledgeable and we felt in good hands. I'd say that maybe a very slight comment is that a Croatian crew and cooking etc is always going to be a little more "Eastern European" than, say an Italian crew. This is not to say it was lacking, just a little different and perhaps requires a little more communication. Thanks for everything. Was really a wonderful holiday I'd love to do a boat trip again. Renting a yacht or charter boat in Europe is a great way to travel and explore the surrounding areas. There are many companies that specialize in matching customers with the ideal yacht or charter experience.

But how much can you expect to spend on these services?

In this article, we will look at the cost of chartering a yacht in Europe.

The Basics of Yacht Charter Pricing

There are a few considerations that are in place when pricing the cost of a boat rental:

  • One is the location of the charter yacht. This will factor in things such as local taxes.
  • Another consideration is the type of yacht .
  • A third thing to keep in mind is the base cost. For example, if the yacht has a celebrity owner, then this can affect the overall price.

There can be a wide range of base prices, from $10,000 a week for a small sailing yacht to more than $150,000 a week for a super luxurious motor yacht.

All-Inclusive Options

Some charters, such as those in the Virgin Islands, have one price for everything that is needed during the yachting adventure.

This mainly applies to catamarans and monohull charters.

These rates are based on the number of guests and include all of the food and drink, fuel costs, and watersports. Taxes and docking fees may be added separately.

Plus Expense Charters

Larger yacht rates do not include the expenses of running it. The base price is for only the yacht .

Additional expenses include:

  • The bar tap
  • and any other fees that are accumulated separately.

Most often, an Advance Provisioning Allowance pays for the running expenses. This may normally be 35% of the base price, and it is paid prior to the charter.

At the end of the trip, the captain will present an itemized report that shows the individual costs accrued during the charter. If the amount is less than the original fee put down, then the balance can be returned.

If it’s over, then it’s up to the person renting the boat to pay the remaining balance.

Base Prices On 3 Yacht Types

This list details the size of the yachts, and the average base prices per week.

Of course, these prices will vary depending on the charter you select.

1. Sailing Yachts

  • Sailing Boats Under 80 ft.: $10,000-$20,000 per week
  • Sailing Boats from 80-120 ft.: $20,000-$50,000 per week
  • Sailing boats from 120-150 ft.: $50,000-$100,000 per week
  • Sailing boats exceeding 150ft: $100,000-$200,000 per week

2. Catamarans

  • Catamarans less than 50 ft.: $10,000-$15,000 per week
  • Catamarans from 50-65 ft.: $15,000-$30,000 per week
  • Catamarans between 65-80 ft.: $25,000-$50,000
  • Catamarans greater than 80 ft.: $40,000-$100,000

3. Motor Yacht Charter

  • Motor yachts less than 80 ft.: $15,000-$35,000
  • Motor yachts from 80-120 ft.: $35,000-$80,000
  • Motor yachts from 120-150 ft.: $80,000-$150,000
  • Motor yachts greater than 150 ft.: $150,000-$500,000

Yachting companies have published prices, and may not negotiate on prices.

Working with a private owner might yield more leeway in terms of the cost of the yacht.

Some yachts are privately owned, while others are owned by a company. Yacht owners will set the prices for the boats , which is one reason why the prices vary so greatly.

There are a few other considerations that will impact how much it costs to charter a yacht.

1) Factors Regarding The Yacht Itself

The year the yacht was built, the owner, the size, and the features will all impact the price the yacht is.

A crewed vessel carries its own price tag. The price will increase if the buyer wishes to include a crew along with the cost of renting the boat.

All-inclusive yachts will factor in the cost of hiring a crew along with the necessities that the renter will need. Having an experienced crew will be helpful for beginners or those taking a vacation.

Other yachters might prefer to run the ship themselves.

There are other fees that will add up. These include insurance costs, delivery fees, crew gratuity, and more.

Yachts are a big investment for the owners, and this is the reason why the costs can be expensive. If the yacht is booked for 2/3 of the year, then the crew’s expenses need to be condensed into this time frame.

  • French VAT – 20%, however 10% can be applied when an itinerary has International Waters included
  • Italian VAT – 22%, however 6.6% (over 24m) and 8.8% (under 24m) are applied with an itinerary including International Waters. 
  • Spain VAT: 21%
  • Greek VAT: 12%
  • Croatian VAT: 13%

There has been talk in recent days that Penny Mordaunt could be a possible replacement for Rishi Sunak if unhappy Tory MPs kick him out before the election.

But the Commons leader has insisted her focus is on the job in hand.

Reporters shouted questions to Ms Mordaunt as she left this morning's cabinet meeting.

As you would expect, they were about the suggestions she could step in if Mr Sunak is ousted.

"I'm getting on with my job and I recommend it," she replied.

Ed Miliband has accused the Conservatives under Rishi Sunak of slipping from "climate delay to denial", as he made a pitch to voters on green issues.

The shadow energy security and net zero secretary claimed the PM was willing to stoke culture wars on climate change, but that did not reflect the views of British people and risked damaging the country's future.

But the Tories claimed Labour's plans to decarbonise the grid by 2030 - rather than 2035 as they have pledged - would see "costs implode" and raise taxes, while they had a plan to cut emissions in a "pragmatic way".

In a speech to the Green Alliance thinktank, Mr Miliband warned the forthcoming general election was the most important on climate and energy the UK has ever had.

He said: "There is a stark election choice: Labour's case for climate action as the route to lower energy bills, energy security, good jobs and doing our duties by future generations against a Conservative Party slipping from climate delay into denial which will mean higher bills, energy insecurity, fewer jobs and betrayal of future generations.

"Families across the country are united in their desire for good jobs, lower bills, cleaner water, and a green and pleasant home that we can leave for our children.

"Instead of embracing this mainstream majority, Rishi Sunak is willing to give up the fight for lower bills and energy security because he wants to stoke the fires of a culture war".

Earlier today, Prime Minister Rishi Sunak held his weekly meeting with members of his cabinet inside Number 10 Downing Street.

Despite a tough few weeks for him, and unrelenting talk of a Tory plot to oust him, Mr Sunak appeared in good spirits.

One year ago, Rishi Sunak made five pledges for voters to judge him on.

The prime minister met his pledge to halve inflation by the end of 2023, leaving four pledges outstanding.

However, he is faring less well with his other pledges.

It has been confirmed the UK is now in recession, which means the PM's pledge to grow the economy is not being met.

With the general election approaching, how is Mr Sunak doing on delivering his other promises?

There will most likely be a general election at some point in 2024, but we don't know exactly when. 

Rishi Sunak has said it will not happen on 2 May - when local elections will take place across England. 

The prime minister's "working assumption" is that it will be in the second half of this year, but beyond that we know very little more about the precise timing.

So why is this the case?

The Sky News live poll tracker - collated and updated by our Data and Forensics team - aggregates various surveys to indicate how voters feel about different political parties.

Labour is still sitting comfortably on a roughly 21-point lead, averaging at 44.1% in the polls, with the Tories on 23.1%.

In third is Reform UK on 11.3%, followed by the Lib Dems on 9.8%.

The Green Party stands at 5.8%, and the SNP on 2.9%.

Former Tory leadership candidate Penny Mordaunt may have poured cold water over talk of her gunning for the PM's job ( see 11.02 post) , but speculation about Rishi Sunak's future is unlikely to go away.

Our political correspondent  Gurpreet Narwan   says rumours that Tory MPs are plotting to overthrow Mr Sunak before the election are a sign of "real despondency within the party".

"We're hearing from MPs all the time that they fear the public's stopped listening to them altogether," she says.

"They're not getting a positive response on the doorstep and with the party languishing 20 points behind in the polls, there's real frustration among MPs who fear they're going to lose their jobs.

"While there's clearly no firm plot yet, all this is a sign of the real despondency within the party.

"Especially as it looks as though it's going to have to limp on to autumn, with the prime minister shooting down suggestions of an election in May."

After a bad few weeks - from the spring budget failing to provide any bounce in the polls, to the defection of Lee Anderson to Reform - it's an "uphill battle" for the prime minister to lift the mood.

Andrew Mitchell, the Foreign Office minister, is now responding to an Urgent Question in the Commons on the situation in Israel and Gaza.

He said he is "deeply concerned" about the situation in Gaza, as Labour's shadow foreign secretary warned of "catastrophic levels of hunger".

David Lammy said that famine in the region is "imminent".

'It's unbearable - and must not go on'

Mr Lammy added: "Half the population is expected to face catastrophic levels of hunger, the highest number of people ever recorded under this system.

"Only twice in 20 years have famine conditions been reached, but what distinguishes the horror in Gaza from what has come before is this is not driven by drought or disaster - it is man made.

"It is the consequences of war, it is the consequence of aid that is available not reaching those who need it.

"Food is piled up in trucks just a few kilometres away while children in Gaza are starving. It's unbearable - and it must not go on."

Mr Lammy says the restrictions on aid flows in the region are "completely unacceptable".

He asks if the government will join Labour's call for an immediate humanitarian ceasefire.

Aid truck provision 'woefully short'

In response, Mr Mitchell says the UK is doing "everything we can" to try to head off the threat of famine in Gaza.

He also confirms 192 aid trucks did reach the region on Sunday.

"But that is woefully short of what is required," the minister adds. 

"Before the crisis, more than 500 trucks a day were getting in."

A proposed takeover of The Telegraph newspaper by a UAE-led consortium will be referred to the competition watchdog.

Culture Secretary Lucy Frazer said she was "minded" to send the deal to the Competition and Markets Authority (CMA) following advice from regulator Ofcom, which will kick off a long review.

The consortium looking to buy the newspaper is RedBird IMI - a joint venture an Abi Dhabi investment group and a US fund manager.

The CMA review could effectively kill the proposed takeover because while it's taking place, a law is due to come into force that would ban foreign governments owning British newspapers.

Ms Frazer said Ofcom had found Abi Dhabi's IMI may wish to influence "the accurate presentation of news and free expression of opinion in the Daily Telegraph and Sunday Telegraph newspapers".

She expects the new law banning governments from owning papers to come into force within the next month or two.

"If the Telegraph case is still live, it will affect it," she told LBC radio.

Our business correspondent Paul Kelso explained there are specific concerns around the role of Sheikh Mansour, a member of the Abi Dhabi royal family and vice president of the UAE.

He's funding 75% of the proposed £600m takeover deal.

"With a poor record of freedom of media expression in Abu Dhabi, there would be a reduction potentially in freedom of expression in the Telegraph," says Paul.

Rachel Reeves, the shadow chancellor, asks Jeremy Hunt whether the Conservatives have costed a reported plan to abolish national insurance tax.

She says: "After the budget, the chancellor wrote to Conservative Party members, telling them that the government planned to abolish national insurance.

"The economic secretary said that national insurance will vanish, and the prime minister said it was his ambition to abolish it.

"So can the chancellor confirm whether he asked the Office for Budget Responsibility to cost the government's unfunded plan to abolish national insurance contributions?"

In response, Mr Hunt largely dodges the question.

He says he is "glad" Ms Reeves asked about national insurance cuts.

"First, she supported them, then she abstained in the lobbies, now she appears to be against them," he adds. "Like the bankers bonus tax which she was strongly in favour of and then strongly against.

"Isn't the actual truth here that where Labour should have an economic policy, there is just a black hole filled with platitudes?"

Mr Reeves pushes again on her question.

Mr Hunt says: "We specifically said we wouldn't fund national insurance cuts from increasing borrowing or cutting spending on public services."
