UK Boat Auctions: Buying A Boat For A Bargain Price

Eight top tips for boat auction success

1. Make sure you understand the true market value of the boat model. 2. View the boat with a surveyor during an allocated visiting window. 3. Do your maths in relation to the full cost of repair. 4. Factor in the auction fees and boat transport costs. 5. However exciting the auction gets, stick to your budget. 6. Don’t be tempted by a bigger boat than you can afford to own and run. 7. Understand that bidding is not a game. It is a legally binding process. 8. Once you’ve ‘won’ a boat, make sure it is formally registered in your name.

It’s easy to imagine that a boat auction involves a succession of unloved wrecks that have spent years on estuary banks, going slowly green and waiting for someone to take pity. But if you’re keen to find a pre-owned boat at a fraction of its market value, a boat auction is actually a much more versatile and dynamic place to go shopping than a lot of people think. Now, as ever, the most common type of lot at a traditional boat auction tends to be a repossessed boat or a compact project craft that has been damaged or abandoned – and for the most part, these often seem to take the form of small sailing boats and river cruises , as well as tenders , dinghies , canoes and kayaks . But while it’s still perfectly possible to hunt down a decades-old yacht for little more than pocket change, a good modern auction will also now display plenty of more recent boats of every shape and size, alongside a healthy spattering of new boats from local dealers. In terms of the buying process itself, there are certainly some unique guidelines that you need to understand when bidding at the auction but, in the first instance, getting a great deal involves exactly the same kind of research as you would lavish on a regular boat purchase…

How do you prepare for a boat auction?

As the buyer, it is always your job to put together a dossier of information to satisfy yourself that the boat in question is worth buying – and if you want to avoid ‘bidding blind’ or getting carried away and overpaying on the day, the same applies to buying a boat at auction. If you’re looking at a particular model, take a look at comparable boats on sales and brokerage websites to assess its potential market value. A list of auction boats is generally made available around a month before an auction, so if the boat is of sufficient value, it makes good sense to take advantage of the auction’s allocated visit times to inspect the boat with your surveyor . That will help you formulate a list of works required and to assess what kind of sale price would represent an authentic saving. In the absence of a sea trial , of course, neither you nor your surveyor will be able to uncover every potential problem but this remains a key step in helping mitigate the risks.

How does a boat auction work?

When you attend an auction in person, winking suavely at the auctioneer is not the way to bid. Instead, simply hold your paddle aloft in a clear and obvious fashion. If the auctioneer describes your bid as ‘provisional’, that means you haven’t yet reached the reserve price but that’s not to say that your bid won’t be accepted by the vendor. There may be a bit of negotiation but if your provisional bid is accepted (as is quite common), you are legally bound to complete the deal. Preferred payment methods vary from auction to auction so, whether you are bidding in person or online, make sure you know what is expected of you and be prepared to pay for the boat immediately and in full. Once payment has been made, you need to attend to two key jobs. Firstly, if you come away from the boat auction with a Bill of Sale but no formal title documentation, you need to get the boat registered in your name. And secondly, you need to organise the removal of your boat from its existing location. Auction boats are often put up for sale by Harbour Authorities specifically to clear space for new boats and new boaters, so you need to be proactive in talking to the marina, getting it shifted and paying for any delay while that happens. Clearly then, it’s important to do your sums before you bid. In addition to the expense attached to the boat’s relocation, make sure you factor in ownership costs, like insurance, maintenance , berthing and fuel. As the buyer, you should also be aware that you will need to pay an auction fee of between 10% and 15%, often with the proviso that a minimum fee applies if the sale price is particularly low. This figure does vary from auction to auction but in all cases, make sure you understand exactly what the all-in costs are likely to be, so you can bid from a position of confidence and authority.

What about other forms of boat auction?

If finding a local boat auction in the UK proves difficult, and you’re happy to join the throng of browsers on a non-specialist site, mainstream auction-style platforms like eBay can certainly help. And there are also now new forms of boat auction developing, through progressive operators like the Boatshed Group. Boatshed’s BoatBid platform is particularly interesting because it positions itself as a middle ground between a regular brokerage and a traditional auction. Instead of paying the full amount on a binding deal at the completion of the bidding process, the winning bidder signs a Purchase and Sale Agreement and provides a 10% deposit. They can then survey and sea trial the boat prior to making a final decision on whether or not to complete the purchase. At a stroke, that takes a lot of the risk out of the process and brings it much more closely into line with a conventional brokerage transaction – but as a result, the potential savings also tend to be significantly reduced.

If you’re keen to really maximise those savings, a salvage auction is generally a more promising option. These tend to involve boats that insurance companies deem too expensive to fix, but if you’re experienced in the field of marine maintenance and repair, there are still bargains to be had. And if you’re a supremely confident DIY fan in search of a low-value project boat (and you’re not intimidated by the clear and obvious damage that often results from flooding or fire) a boat auction site like www.boatwrecks.com is also a good place to look.

Allied Yachting develops its repossessed boats and distressed yachts program mainly in Europe and works with various European Banks and other Financial Institutions. For knowledgeable yachtsmen, these are often excellent deals to purchase a yacht .

Since 2008 Europe is submerged in a difficult economical downfall called the “Eurozone Crisis”, which has particularly affected the yachting industry. Our company has been in permanent contact with selected banks, leasing companies, law firms and private corporations or individuals who have become trustees of illiquid assets. These Sellers work with us in order to find the most effective way to sell seized, repossessed and distressed yachts.

Our program is not limited to bank repos, it also presents opportunities from leasing and other financial institutions, private owners urged to sell and boats in stock.

Bank repossessed boats and distressed boats may frequently be neglected and in questionable aesthetic and technical condition. Indeed, when dealing with such inventory, you are generally negotiating with bankers, accountants or lawyers who don’t want to spend more money in the vessel(s) they’ve just seized or reclaimed.

Generally, this type of transaction also presents complex formalities, legal and tax implications which we’re very efficient in solving. In most cases, this is different from private sellers urged to sell or boats in stock, where you have someone who understands yachting in front of you. Normally, this type of purchase is “as-is; where-is”.

We receive quarterly lists of inventory which provide great opportunities to our clients as they’re informed first-hand about emerging deals.

How we Work

Our main objective at Allied Yachting is to benefit the buyer and the seller, seeking always the best deal for both parties, and mostly by assuring a safe transaction and managing all the appropriate paperwork and formalities involved in buying or selling a bank repo or distressed boat.

In short, a comprehensive program for the whole process of purchasing or selling a financially distressed vessel.

The Bidding and Purchasing Process

• Help you identify and locate the yacht of interest.
• Provide you with a preliminary report of the vessel in order to assess if it’s worth your time.
• Objectively help you evaluate the condition of the boat.
• Organize and attend your inspection.
• Advise you on how to submit a bid in writing.
• Await response patiently, indeed this sometimes takes a few days since it often involves a committee decision from the Seller(s).
• If your bid is accepted, a contract is drawn up, including formalities, fiscal and legislative compliance requirements.
• The boat will then be surveyed and sea-trialled by a qualified marine surveyor, as appointed and paid for by the buyer.
• The surveyor(s) will then provide a written appraisal of the boat, engines, drives and other relevant components.
• If the survey report is acceptable, the sale will be completed as per the agreed terms on the sales contract.

While we recommend the use of the Mediterranean Yacht Brokers Association Memorandum of Agreement (MYBA MoA), some institutions may ask their counsel to prepare and submit an alternative contract.

Safeguard of Funds in Escrow (Stakeholders)

Allied Yachting provides an escrow account for clients’ funds and ensures that at closing, as stakeholders, any existing loan or other encumbrances are paid off, as well as the fees of other parties involved in the transaction. This safeguard is of especially critical importance to the buyer and seller and can be a potentially serious hazard in a transaction like this.

Some financial institutions may prefer to use an independent Law Firm or Notary Public as an escrow agent.

Survey & Sea-Trial

The buyer is responsible for the appointment and payment of a qualified marine surveyor to inspect the boat.

A sea-trial, also borne by the buyer, is necessary as the yacht may have been immobilized for a significant period of time. The costs involved in survey and sea-trial are generally the manoeuvres of bringing the yacht ashore and back into the water, fuel, crew and sometimes careening, antifouling and anodes, so the boat performs adequately.

The surveyor’s report will generally be determining whether the sale proceeds or not.

Legal & Tax Advice

Most of this inventory is generally Ex-VAT and Allied Yachting can provide all the necessary tax and legal solutions to acquire this kind of marine inventory.

Many yacht Sellers may also decide to liquidate a marine inventory through boat auctions.

Whilst these auctions are open to the public and retail buyers as well as nautical professionals, they don’t happen very often.

Some auctions occur yearly on the French Riviera in Cannes and Antibes. Other auctions are also held in Italy, Spain and Great Britain.

An online auction is selling boats seized from a harbour for just £80

More than 20 craft impounded from Bristol harbour, which is just 88 miles from Birmingham, going under the hammer during online auction

Birmingham is a land-locked city - but many Brummies still long to own their own boat.

Now there's a chance to snap up a cut-price craft with an online auction selling boats for as little as £80.

Vessels impounded at Bristol harbour - which is just 88 miles from Birmingham - are set to be sold online between February 1 and March 1, with 82 per cent of proceeds to go towards regeneration of the harbourside, BristolLive reports.

There will be 22 boats - ranging in size and condition - going under the hammer. Auctioneer Graham Cockle said: “The  boats  are seized for various reasons by the Harbour Authority.

“Some people just disappear, while other people just fall into arrears so much they decide the boat’s not worth it and the Harbour can have it.

“We run an auction of this kind around every two years. I’d estimate we raised around £16,000 for the Harbour last time, and we’re targeting something in that region again.”

Mr Cockle, owner of Crown Consultants and Auctioneers, believes the most attractive 'lot' will be a classic Nelson Pilot boat dating back to 1969. More than 40ft in length and 11ft wide, the “star attraction” twin-engine Nelson is named The Queen of Sheba and worth around £15,000.

The auction listing says the boat has seating for up to eight people and is in “remarkable condition given she has languished in the Bristol Harbour for a few years”.

On the other end of the scale are dinghies, canoes and other boats expected to go for a lower price.

Mr Cockle said: “If you have the DIY aspect about yourself, there will be some you can pick up for about £80.  We have boats going back as far as the 1960s, and if they’re a good representation of a very early model, there might not be many around.”

Buyers will not be able to just keep their new boats moored in Bristol Harbour, with a waiting list of more than a year for a berth.

“You’ll have 30 days to remove your boat from the Harbour after the auction, because it would have to go on a waiting list,” Mr Cockle said.

“Money raised from the sales goes back into the Harbour, so it’s a good thing for the local community and it clears away the boats no longer being used.

“The Harbour is evolving all the time, and it needs to have the old removed to make room for the new.”

National Liquidators prides itself on our weekly sealed bid auction platform. Bidding closes every Monday at 4:00 p.m. (ET).  Offers may be submitted in one of two ways:

1. Online by clicking the orange Submit an Offer button within the listing.

2. Filling out the Official Offer Form, and emailing the form directly to your broker or to [email protected] .

All offers can be made subject to survey, inspection or sea trial at the buyer’s expense. Please make sure this is indicated on the Official Offer Form when submitted. All offers will be turned over to the sellers to accept, reject or counter.  Once accepted, the buyer shall tender a 10% refundable deposit, and schedule their required inspection and/or surveys.  Closing shall occur no later than 7 days past acceptance of the offer.

OFFER PROCEDURES

Offers are accumulated weekly through each Monday at 4:00 PM ET. In the event a particular Monday is a Federal Holiday, the deadline is extended an additional 24 hours. The high offer on a particular vessel is submitted to the Seller for consideration the following business day. The Seller, at its sole option, may accept or reject with or without a counter offer. Responses typically occur within 48 hours, no response constitutes a rejection of theoffer.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 1 business day to deposit into National Liquidators escrow account, the greater of 10% of Gross Offer or $1,000.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 5 business days to complete any and all conditions listed above in the “Conditions Of Offer”. In any case, any remaining amounts due must be deposited into National Liquidators escrow account, within 5 business days after notification of acceptance of an offer (either verbal or electronic). Successful Bidder’s failure to fund the total offer price within 5 business days after notice of acceptance will result in forfeiture of any deposits. In these instances, the vessel will be placed back into the auction cycle.

After funding the total offer price, Successful Bidder must remove the purchased vessel from National’s storage facility within two business days or make storage arrangements with National. Storage charges will accrue on ALL purchased vessels until each is removed from National’s storage facility. All vessels are sold AS IS, WHERE IS, with no warranties or representations, express or implied, as to condition or fitness for a particular purpose.

NOTICE REGARDING TITLING OR US COAST GUARD DOCUMENTATION

National Liquidators makes no guarantees, representations or warranties as to title or the ability to document or register the vessel. National Liquidators are acting as a broker only and issues as to title, documentation and registration are between the Buyer and the Seller, owner or lien holder. The required $399.00 administrative fee covers National’s efforts to obtain titling and documentation information from the Seller; it does not include transfer of title or documentation to Buyer. National Liquidators can process transfer of title or documentation to Buyer an additional fee. Buyers that are interested in this service can contact National’s title department for details, including charges. Ohio Law requires National to transfer title (not USCG documentation) directly to Ohio residents only, a $150 fee is charged for this service.

IMPORTANT INFORMATION REGARDING SALES TAX

Purchasers must pay sales tax at the applicable rate in their respective states. Dealers that wish to be treated as tax-exempt are required to provide a state sale tax number, valid marine dealer’s certificate, sign a Resale Certificate or Statement for Exemption of Purchase, and any other required documentation.
