Officer ‘motorboated’ subordinate at promotion ceremony, retires after guilty plea

A former Louisiana National Guard officer was allowed to retire after a general court-martial convicted him of charges stemming from “motorboating” a subordinate soldier during an informal promotion ceremony while deployed to Jordan in May 2021, Army Times has confirmed.

Capt. Billy Joe Crosby Jr., a logistics officer who was overseas with the 256th Infantry Brigade Combat Team during its recent deployment, was initially charged with abusive sexual contact and conduct unbecoming an officer, according to court records obtained by Army Times. Crosby was the officer-in-charge of an outpost in Jordan.

Maj. Jessica Rovero, a spokesperson for the command overseeing the trial, told Army Times in a statement that Crosby’s “behavior is not in line with the Army values.”

Rovero added that “multiple Soldiers immediately reported the behavior, and Crosby pled guilty at trial.”

The guilty plea came with strings attached, though.

The officer struck a deal that erased the abusive sexual contact charge. He pled guilty to assault consummated by battery — a non-sexual offense — and conduct unbecoming, records reveal.

Crosby, a prior enlisted soldier who participated in the 1989 invasion of Panama, was confined for 30 days. The plea deal also prevented the judge from dismissing him from the Army, which would have kept him from collecting his retirement.

A Louisiana National Guard spokesperson, Lt. Col. Noel Collins, confirmed that Crosby retired March 31 after completing his confinement and returning home.

Crosby did not respond to an emailed request for comment.

What did Crosby do?

When he learned that the junior soldier was selected for promotion, Crosby reportedly announced to her twice that he intended to “motorboat” her during her promotion ceremony because the Army Combat Uniform’s chest-placed rank patch was intended for such actions.

An NCO witnessed both statements, according to a motion filed by prosecutors.

Prosecutors described “motorboating” as “when a person places his or her face between a [woman]’s breasts and shakes his or her head back and forth while making sounds resembling a boat motor.”

Weeks before the assault, Crosby also told the NCO that he wanted to bring the junior soldier with him on a driving trip to another base in Jordan. The NCO told investigators that Crosby requested the soldier’s company because “he liked looking at her tits.”

The junior soldier told Crosby the day before the assault that she did not want a promotion ceremony.

But during work the following day, according to a prosecution motion, Crosby “approached [the junior soldier], told her to stand up, placed the rank in front of her chest, leaned in the grab the rank with his teeth...then placed his face between [the junior soldier]’s breasts...[and] vigorously moved his head from side to side between [her] breasts while still holding the rank with his teeth.”

It’s not clear when the crime was reported, nor is it clear who reported it, but court documents indicate that agents from the Army’s Criminal Investigation Division were interviewing witnesses within two weeks of the incident.

Crosby, who initially declared he would plead not guilty, changed his plea after negotiating a deal that reduced the charges and protected his retirement. The removal of the abusive sexual contact charge, which was dismissed as part of the deal, also meant that he did not have to register as a sex offender.

Although the deal took away the possibility of an other-than-honorable discharge and reduced his maximum confinement to 120 days, the judge only sentenced Crosby to 30 days and did not direct a reprimand, fines or forfeitures.

Crosby’s brigade had other disciplinary issues during its 2021 mobilization, which saw most of the unit sent to the Middle East. Some other elements of the brigade went to the federally controlled mission supporting officials at the U.S.-Mexico border.

A Louisiana Guard cavalry troop operating in south Texas was temporarily disbanded after widespread issues with sexual harassment, discipline and command climate. The state returned its troops from the border mission a month ahead of schedule after two soldiers died in alcohol-related incidents, though a state spokesperson said the move was unrelated to the problems the units had faced.

Toyota reaches $1.2 billion settlement to end probe of accelerator problems

Toyota Motor lied to regulators, Congress and the public for years about the sudden acceleration of its vehicles, a deception that caused the world’s largest automaker on Wednesday to be hit with a $1.2 billion Justice Department fine.

Prosecutors say Toyota’s efforts to conceal the problem and protect its corporate image led to a series of fatalities that could have been prevented. The settlement, which amounts to more than a third of Toyota’s 2013 profit, is being called the largest criminal penalty imposed on a car company in U.S. history.

Toyota says in the settlement that it misled Americans by making deceptive statements about the safety problems that caused its vehicles to speed up uncontrollably, a stark admission for a company that has built its brand on safety and reliability.

Early on, Toyota suggested that driver error was to blame, saying that some people may have hit the gas when they meant to hit the brake. Even after issuing recalls to address problematic floor mats that in some cases pinned down accelerators, the company hid a flawed gas pedal design that it knew did the same thing, according to documents accompanying the agreement.

The deal is a victory for the government and could serve as a model for a case against General Motors, which is under investigation by Congress, safety regulators and federal prosecutors for taking more than a decade to issue a recall for an ignition-switch problem it has linked to 31 accidents and 12 deaths.

“Companies that make inherently dangerous products must be maximally transparent, not two-faced,” said Preet Bharara, U.S. attorney for the Southern District of New York, who led the Toyota investigation and — according to a law enforcement source who spoke on the condition of anonymity because he was not authorized to discuss the topic — has launched a preliminary criminal probe of GM. “That is why we have undertaken this enforcement action. And the entire auto industry should take notice.”

Safety fears erupted around some of Toyota’s most popular models in 2009, when California Highway Patrol officer Mark Saylor and three family members were killed in a high-speed crash caused by the unintended acceleration of his car. The terrifying episode was captured in a 911 emergency call in which Saylor’s brother-in-law described speeding out of control in a Lexus at more than 125 mph before the car crashed, killing all four occupants.

Relatives of the Saylor family, who settled a case against Toyota for an undisclosed amount in 2010, declined through their attorney to comment on the new settlement.

After the accident, Toyota eventually recalled millions of vehicles — one of the largest recalls in the history of the automotive industry. But federal prosecutors found that the company had not come completely clean.

The company assured the public that the “root cause” of unintended acceleration had been addressed by the recall, blaming floor mats that accidentally trapped the depressed gas pedals of cars and trucks.

But Toyota knew that models it had not recalled had similar floor-mat problems, the agreement said. Also, the company hid from federal regulators a second cause of unintended acceleration in its vehicles: a sticky gas pedal.

The problem was caused by plastic material inside the pedal that could cause the accelerator to become stuck in a partially depressed position. The pedals were installed in several models, including the Camry, the Matrix, the Corolla and the Avalon.

The problem had surfaced in Toyota vehicles in Europe in 2008, causing instances of uncontrolled acceleration. In early 2009, the company gave European Toyota distributors information about the sticky pedals along with instructions to replace them if customers complained.

Meanwhile, rather than issuing a recall, the company quietly directed its pedal supplier to change parts in Europe and made plans to roll out the same change in the United States.

By then, the problem had already cropped up in cars sold in the United States, according to the documents. At nearly the same time as the highly publicized San Diego accident, Toyota staffers sent a memo to the company’s headquarters in Japan warning of an unintended-acceleration problem apart from the one caused by the floor mats.

For several months, Toyota received more evidence of the pedal problem and quietly made plans to address it without informing federal safety officials as required by law. Concerned that federal officials would learn about these plans, the company canceled the change in pedal design and communicated that change orally rather than in writing, so there would be no paper trail.

After more instances of sticky pedals came to the company’s attention in 2009, executives decided to disclose the issue to federal regulators and issue a new recall. But the deception did not end there. After the recall was completed, the company produced an inaccurate timeline and submitted it to federal regulators and Congress, making it appear as if the company had acted quickly to address the sticky-pedal issue.

“Rather than promptly disclosing and correcting safety issues about which they were aware, Toyota made misleading public statements to consumers and gave inaccurate facts to members of Congress,” Attorney General Eric H. Holder Jr. said at a news conference announcing the settlement.

As part of the deal, Toyota has entered into what is called a ­deferred-prosecution agreement that gives federal prosecutors the right to pursue criminal charges if the carmaker fails to live up to the agreement, according to the department.

The automaker must acknowledge the facts of the government’s case and have an independent monitor review its safety practices. None of its employees will face criminal charges.

Christopher P. Reynolds, chief legal officer at Toyota Motor North America, said the company took full responsibility for the effects of its actions on consumers at the time of the recalls.

“We have made fundamental changes across our global operations to become a more responsive company,” he said in a statement. “Entering this agreement, while difficult, is a major step toward putting this unfortunate chapter behind us.”

In addition to the $1.2 billion fine, which will go into the government’s coffers, Toyota faces nearly 400 wrongful-death and personal-injury lawsuits. It has settled at least seven lawsuits in the past few months.

“The Justice Department settlement with Toyota is a complete game-changer,” said Clarence Ditlow, executive director of the Center for Auto Safety, a watchdog group. “Until today, automakers faced insignificant fines and no criminal penalties under the Vehicle Safety Act. Today’s fine of $1.2 billion against Toyota makes the $35 million maximum fine that [federal regulators] can impose seem like chump change.”

Still, critics of the settlement say the hefty fine means little as long as no executives face jail time. The facts of the case describe a level of coordinated lying and greed that warrants stiffer punishment, they say.

“Money as a deterrent is of no consequence to these overpaid and overindulged individuals, as the companies are flush with cash,” said David H. Peirez, a partner at the law firm of Reisman, Peirez, Reisman and Capobianco. “Deferred-prosecution agreements are a joke — all they defer is a jail sentence, but not the next recall.”

  Car Dealer Liability for Misrepresentation When Selling a Vehicle

Vehicle dealers are prohibited by federal law from misrepresenting either the mechanical condition of a vehicle or the terms and conditions or the existence of a warranty for a vehicle. If an individual has relied on a false or misleading claim when purchasing a faulty vehicle, they may have a claim against the automobile dealer that sold them the vehicle.

In general, there are two types of claims which are related to deceptive automobile dealings, including:

  • Fraudulent misrepresentation; and
  • Negligent misrepresentation.

Suing a car dealership for misrepresentation may be possible in certain circumstances. If an individual has already purchased a vehicle and later determines that something is wrong with it, they may have a cause of action against the car dealer. 

In order to sue a car dealership for misrepresentation, the individual must show:

  • The car dealer omitted or misrepresented material facts regarding the vehicle;
  • The individual suffered a financial loss as a result; and
  • The individual would not have purchased the vehicle if they were aware of the material facts at issue.

In order to prove these issues, the individual will need to show that they inquired about the condition of the vehicle and that the salesperson denied there were any issues with the vehicle. An eyewitness to the misrepresentation would be extremely helpful to an individual’s case.

What is Fraudulent Misrepresentation?

Fraudulent misrepresentation can be defined as any type of false statement or lie that is used to trick an individual into an agreement. The misrepresentation may occur in many ways, including:

  • Written words;
  • Spoken words;
  • Gestures or body motions, such as a nod, and
  • Through silence or inaction.

Fraudulent misrepresentation is often raised in connection with contract law issues. An example of fraudulent misrepresentation occurs when a party purposefully makes a statement which is false to the other party for the purpose of inducing them into signing the contract. 

For example, if an automobile dealer lies regarding the accident history of a used vehicle in order to get an individual to sign a purchase contract, then it may be considered fraudulent misrepresentation.

Fraudulent misrepresentation includes six elements. In order for a plaintiff, or an individual who files a lawsuit, to recover for fraudulent misrepresentation claims, they must prove all 6 elements. The elements a plaintiff must prove to sue a car dealership include:

  • It is important to note that representations typically involve a direct statement but any speech that is intended to communicate a fact or create an impression, illusion, or belief, may be considered a representation;
  • The car dealer was aware that the representation was false or made the representation recklessly without knowing if it was actually true at the time;
  • The car dealer make the representation with the intent that the plaintiff would rely upon it;
  • The plaintiff, or individual who purchased the vehicle, relied upon the representation;
  • It was reasonable for the plaintiff to rely upon the representation; and
  • The plaintiff suffered economic damages as a result of relying upon the false representation.

Proving all of these elements in court may be complicated and requires the aid of a skilled lawyer. A lawyer is best equipped to gather evidence of the car dealer’s deceptive trade practices, obtain witnesses to testify regarding the deception, and advocate for the plaintiff in court.

Negligent misrepresentation in a contract setting occurs when an individual states a fact without verifying whether or not it is true. Pursuant to both real estate and contract law, negligent misrepresentation is a civil wrong. 

Negligence involves an individual’s duty to act reasonably under a given set of circumstances. If an individual is a victim of negligent misrepresentation, they may be able to sue for money damages in a court of law.

In order to prove negligent misrepresentation, the plaintiff must show:

  • The defendant, or individual being sued, made a representation in a contract;
  • That representation was false;
  • That representation was made either without reasonable grounds to believe it was true or carelessly;
  • The plaintiff reasonably relied on that representation; and
  • The plaintiff’s reliance on that representation was the legal cause of the plaintiff sustaining damages.

A representation is a statement, such as “the brakes work just fine,” that can be proven to be true or false. Reasonable reliance is how an individual with ordinary intelligence and common sense would believe upon hearing or reading the representation. If the individual would not believe the representation, there was no reasonable reliance.

Although fraudulent misrepresentation and negligent misrepresentation may seem similar, they are slightly different. With fraudulent misrepresentation, an individual knowingly makes an incorrect or false statement which is intended to mislead or deceive. 

A negligent misrepresentation, on the other hand, only requires that the individual fail to exercise reasonable care or competence to obtain or communicate information which is true. In other words, they fail to verify information which an individual relies upon.

If an individual is unable to establish the required elements for fraud, they may still have a claim against the car dealer for making negligent misrepresentations . The advantage of a negligent misrepresentation claim is that the plaintiff is not required to show that the seller was actually aware that the representation was false at the time it was made.

Instead, the plaintiff must only show that the car dealer made a representation or representations under circumstances which indicate a reckless disregard for the truth or that they ought to have known that the representations they made were not true. In order to prove a car dealer made negligent misrepresentations, the plaintiff must show:

  • A representation was made by the car dealer;
  • The car dealer knew or should have known that the representation was false;
  • The plaintiff relied on the representation made by the car dealer;
  • It was reasonable for the plaintiff to rely on the representation made by the car dealer; and
  • The plaintiff suffered damages as a result of relying on that representation.

It is much easier to prove that the car dealer should have known that the representation was false than to prove that the car dealer actually knew that the representation was false. If an individual is a victim of negligent misrepresentation in a contract, they may sue for the recovery of damages caused by that misrepresentation.

For example, if an individual purchases a bicycle with brakes that do not work, they may sue the seller for the cost of the brake inspection. In a breach of contract case that deals with a negligent misrepresentation, damages are typically limited to financial damages. Typically, a court does not award damages for personal injury, emotional injury, or pain and suffering in these types of cases.

The plaintiff may also be entitled to an equitable remedy. An equitable remedy is a type of remedy which is non-monetary. 

One example of an equitable remedy is contract rescission . A contract rescission occurs when the court orders a contract to be cancelled, terminating the contract and treating it as though it never existed. 

With a contract rescission, the buyer receives a refund and the property that was sold is returned to the seller. The purpose of a rescission is to put both parties back in the position they were prior to the formation of the contract.
